Probate Tips
There are many "Do's" and "Don'ts" with probate homes and the many issues that come with the disposition of probate property.
Here is a partial list:
Tips To-Do List
- Make certain the property is secure, with windows and doors locked and the keys are with the person who is going to be in charge of maintaining the home. It is important that the home is taken care of, and that the heat is left on a bit.
- Pay the home insurance up to date. Make certain the insurance company knows the situation, and is notified if the home is going to be vacant for a while. There might be an extra charge for an extended time of vacancy, but it is worth paying.
- Locate the will. There may be specific instructions regarding the home or personal property that will need to be addressed right away. Maybe there are pets with instructions for their care.
- Once you have been officially named the administrator or executor of the estate, then the personal property can begin to be sorted through and perhaps a list made. Perhaps some items will be given to family members, others sold, and the rest given to charity.
What Not To-Do
- Do not give anything away or discard any items before discussing it with other heirs. Someone may have a sentimental attachment to something you are not aware of, and you may want to accommodate their wishes.
- Do not have a yard sale. This is not the best way to get the most money for the personal items. Bargain hunters go to estate yard sales (and realtors too).
- Do not pick your probate real estate agent from a yard sale. There are many agents who visit yard sales to try and get listings, and most of these agents have little or no experience with the particulars of probate sales.
- Do not start remodeling without a plan. You may be better off selling the home in as-is condition. And of course, remodeling can only be done if there is money or language in the will and/or agreement among the heirs allowing it.
